Introduction

  1. The Commission encountered reports of torture and other forms of ill-treatment perpetrated on a wide scale by both Qadhafi forces and thuwar. The Commission was able to build upon the findings in its first report by visiting more than 20 places of detention, both when the Qadhafi Government was in control of the centres and also during the later period when the centres were under the control of the various thuwar brigades and/or the interim Government.458 In undertaking these visits the Commission interviewed 84 people currently in detention, both victims and perpetrators, and a large number more who had been released.459 The Commission and its forensic pathologist examined the wounds of a number of torture victims and reviewed medical files, including those of individuals tortured to death. The Commission also met with prison commanders, NGOs, and family members of victims. The Commission has concluded that torture was both widespread and systematically460 perpetrated in Libya throughout conflict Phases II and III.
