The Revolutionary Islamic Court of Tehran DGAM 29640
On 22/8/72 the Revolutionary Islamic Court of Tehran, under the supervision of the undersigned, decided to investigate the case classified under No. 60/TA/2745/1 related to: 1-Hossein-Ali Soudavar son of Samad. 2-Abolala Soudavar son of Samad, 3- Mohammad-Reza Soudavar son of Mohammad, 4- Mrs. Shahnaz (Patricia) Massoudi, 5- Samad Soudavar son of Mohammad, 6- Soudabeh Soudavar daughter of Abolala.
According to the presented facts, the aforementioned people fled the country before the victory of the Glorious Islamic Revolution and settled down in the Land of Infidels. Of these people, the following properties remained:
1 -- a piece of land measuring 43200 square meters situated in Chaboksar of Tonkabon Province belonging to Abolala Soudavar
2 -- a piece of land known as the Malek Caravanserai, belonging to Hossein-Ali and Abolala Soudavar in the custody of their mothers
3- a garden measuring 70632 square meters situated in Karaj and registered under 401 secondary and 9 primary from the district of Mardabad belonging to Hossein-Ali and Abolala Soudavar
4- a real estate measuring 2610 square meters situated in Northwest Tehran with registry No. 17/3735
5 -- a building situated in Revolution Avenue, close to Ferdowsi square, No. 940 measuring 890 square meters belonging to Mrs. Ezzat-Malek Soudavar
6- A property situated in Sepahbod Qarani Avenue No. 46 -- 44 measuring 260 square meters and belonging to Hossein-Ali and Abolala and Fatema Soudavar
7 -- the property measuring 402 square meters registered under No. 29/490 section 3 off to Ron situated in Hafez Street Abivard Street, Kimia Street, No. 19 belonging to Hossein-Ali and Abolala Soudavar
8 -- property situated in Pasdaran Avenue Neyestan 7, Ehteshamieh, Khakbaz Street No. 23
9- a piece of land registered under 1999 and 2000 secondary from 291 primary belonging to Hossein-Ali Soudavar in Esfahan
10 -- a piece of land situated in Esfahan registered under No. 1997 and 1998 secondary from 391 primary belonging to Abolala Soudavar
11 -- shares in Soufar Trading Company divided as follows: 215 shares belonging to Hossein-Ali Soudavar 215 shares belonging to Abolala Soudavar, 20 shares belonging to Mohammad-Reza Soudavar.
12 -- shares in Haml va Naql-e Bozorg Co. divided as follow: Abolala Soudavar 1000 shares and as representative of Merrikh Company, 310 shares
13 -- shares of Dana Public Insurance Company: divided between Hossein-Ali Soudavar 200 shares, Abolala and Mohammad-Reza Soudavar, a total of 3,000 shares
16 -- shares in Khawar Co.
These abandonned properties have been found, and taken over, and have come under the control of Bonyad-e Mostazafan va Janbazan. And according to the orders of the Supreme Leader, a request for judgment has been sent to the bureau of the chief-judge. This case was initially sent with a letter dated 15/9/71, to the fifth court, but because of a high caseload, was re-routed on 12/4/72 to this court. After investigating the content of the presented files, this court issues the following judgment:
According to the facts presented in this case and the request for judgment, Hossein-Ali Soudavar son of Samad, Abolala Soudavar son of Samad, Mohammad-Reza Soudavar son of Mohammad, Mrs. Shahnaz (Patricia) Massoudi, Samad Soudavar son of Mohammad, Soudabeh Soudavar daughter of Abolala, fled the country after the victory of the Islamic Revolution, and have taken residence in the Land of Infidels. After their departure, their abandoned properties was taken over and came under control of Bonyad-e Mostazafan va Janbazan; and for the purpose of determining the fate of these properties, the aforementioned people were summoned through the news media to this court, but have not presented themselves to this date. And since the keeping of these properties is difficult, in accordance with the order dated 17/7/70 of the Supreme Leader, said properties shall be evaluated, and for the purpose of resale, their title shall be transferred to Bonyad-e Mostazafan va Janbazan.
This judgment shall become valid and ready for execution after review and affirmation by the chief-judge of section 1.

This case has been studied, and the investigations of the 6th Revolutionary Islamic Court of Tehran, no. DGAM 29640 dated 29/8/1372 concerning the abandoned properties of the above-mentioned people, and their explanations are recognized as correct, and it is thus affirmed that all said properties should be transferred to Bonyad-e Mostazafan va Janbazan who is in possession of them. A management fee shall be applicable for the management of said properties and payable to Bonyad-e Mostazafan va Janbazan. The Fifth of the value shall be deposited in the special account […]. The remaining moneys should be deposited in the temporary account of Bonyad-e Mostazafan va Janbazan and upon return of the above-mentioned people and subject to a new order, it can be restituted to them.
