4.3. Ensure transparency of work of public authorities. Transparency of work of public authorities shall be ensured in several ways, however, none of them is fully developed. In terms of laws, the most important is the Law on Free Access to Information of Public Importance (“Official Gazette of the RS”, No 120/04, 54/07, 104/09 and 36/10) which guarantees to everyone the right to obtain the information held by public authorities and created in work or in relation to work of these authorities and which is contained in a document. Although the rights provided by this law are broad, the wording of the law can and should be improved. Transparency of work of public authorities should be enabled to all the citizens equally. Authorizations and resources available to the Commissioner for Information of Public Importance and Personal Data Protection (hereinafter referred to as the Commissioner) should be extended, particularly in terms of competences for misdemeanor proceedings. Public authorities should with their internal acts ensure greater governing of transparency of work and actions upon such requests. Also, it is necessary to fully comply with the instructions of the Commissioner for creating and publishing information on work, and to ensure implementation of Commissioner’s final decisions in all cases.
