14. In current times controversies framed by reference to the rule of law continue to require courts to resolve tensions between maintaining civil order (a classic responsibility of governments) and individual freedoms.

Importantly, Magna Carta involved royal concessions. Its history as a constitutional document is a history of reinterpretation eliciting further concessions on a long journey towards constitutional democracy. The repeated concessions broadly give rise to the rule of law marked, as Dicey so famously said, by the spirit of legality
