Schlüter v. Hauptzollamt Lörrach, p. 1161. According to the Court it is the duty of the Community and of Member States to co-operate in and to ensure the creation and maintenance of conditions for a single economic market. According to the Court the obligations for Member States listed in Article 5 EC (now Article 10 EC) and in Article 107 EC (now Art. 108 EC) cannot create legal consequences of which parties might avail themselves in court. Idem. As the Community now has exclusive competence within the field of monetary policy, one can assume that the Community now has replaced the State.
