The Media Bureau (“Bureau”) has before it an application (the “Application”) of Educational Community Radio, Inc. (“Licensee”) for renewal of its license for noncommercial educational (“NCE”) FM station WOBO(FM), Batavia, Ohio (“Station”). The Bureau also has an August 6, 2012, Informal Objection (“Objection”) to the Application by a former officer of the Licensee, Donald F. Littman (“Littman”). In this Memorandum Opinion and Order and Notice of Apparent Liability for Forfeiture (“NAL”),1 we find that Licensee apparently willfully and repeatedly violated Sections 73.503(d) of the Commission’s rules (the “Rules”) and Section 399B of the Communications Act of 1934, as amended, (the “Act”) by airing commercial announcements on an NCE station.2 Based upon our review of the record before us, we conclude that Licensee is apparently liable for a monetary forfeiture in the amount of three thousand dollars ($3,000) and that this matter does not disqualify it from a renewal of its license.
