      1. Sherman Antitrust Act – criminal and civil statute


  • §2  Prohibits monopolization and attempts to monopolize

  • Every person who shall monopolize, or attempt to monopolize, or combine or conspire w/any other person or persons, to monopolize any part of the trade or commerce among the several states, or w/foreign nations, shall be deemed guilty of a felony

  • Liability results only when a company actually monopolizes or dangerously threatens to do so

  • Violation is a felony today, our penalties are higher than most other countries
