Enforcement of Antitrust Laws

  1. DOJ Antitrust Division and the Federal Trade Commission


  • DOJ Antitrust Division – enforces Sherman Act and Clayton Act

  • Individuals may be jailed for up to 10 years or fined $1 million, or twice the victim’s losses

  • Corporations may be fined up to $100 million

  • Private parties can sue based on a decision in a case brought by the justice dept, they have to show that anticompetitive acts impacted them specifically
