(3.1.6.2.6.2) PETER SHERMAN – one source placed this Peter here with dates that obviously would not fit – another source has this Peter, known as Peter 2d in Seneca Co and Tomkins Co NY born March 1788 and died 1872 Decatur Co IN, but his parents cannot be verified, although he is listed in the list of heirs of Peter (3.1.6.2.5) and Keziah (3.1.6.2.7); might be a son of one of Solomon’s brothers. Last Will and Testament of Benajah SHERMAN Deceased


Be it remembered that (_); to wit on the eighth day of August, in the year of our Lord one thousand eight hundred and sixty, JEANNETTE SHERMAN, the executor of named in the Last Will and Testament of a BENAJAH SHERMAN, late of the town of Seneca Falls, in the county of Seneca (_), appeared in open court before the Surrogate of the County of Seneca and made application to have the Last Will and Testament which relates to both Real and Personal Estate, proved, and on such application said Surrogate did ascertain by satisfactory evidence who were the widow heirs of (___ _____ _____ ___ _____) as follows, Jennette SHERMAN, now Jannette HAYS, widow of the deceased; FLORINDA VAN LUYL, LUCRETIA VAN VALKENBURGH; and MARY CRAWFORD, daughters of said deceased, and WILLIAM SHERMAN and JAME SHERMAN, sons of said deceased, all of full age, and residing in said county, or in counties adjoining said county of Seneca. And said Surrogate did thereupon issue a citation in the form of law directed to the widow and heirs, in-laws, and next of kin(____blank__) by their respective names stating their places of residences (__BLANK__) requiring them to appear before said Surrogate in his office in the Village of Waterloo in said county on the seventeenth day of October A.D. 1860 to attend the Probate of said will and satisfactory evidence of affidavits being presented to said Surrogate of the (due?) service of (__?) citations in the mode provided by law, such proceedings were held on the (??_ 17th day of October 1860, (_) that since hearing was continued before said Surrogate, undetermined until afterwards, to wit on the (29th?) day of June, 1865, when upon application of HENRY HERRIMAN (HARRISON?) a creditor (_) Surrogate issued the citations in (_) said widow, heairs at law trust of kin to other (____?) Surrogate other office in the Village of Seneca Lakes in said county on the 28th day of July, he showed cause. And afterwards to wit on the said 28th day of July, A.D. 1865 satisfactory evidence by affidavit was (_) and presented to said Surrogate of (_____ _____ _____ _____) (Several lines not readable..) of Real and Personal Estate and the (_) thereof to be sufficient which said last Will and Testament and this last mentioned (_) are as follows, that is to say: (All handwritten)

Know all by these present that I, Benajah SHERMAN of Seneca Falls, in the County of Seneca and the State of New York, considering the uncertainty of human life, and being of sound mind and memory, do make and publish this my last will and Testament in manner said form following viz;

First I give and bequeath unto my wife, Jennet SHERMAN all my Real Estate, it being all that contain piece and parcel of land or Village lot, situate lying and being on the North side of Main or Fall Street in the Village of Seneca Falls a few rods west of where (Walnut?) Street intersects said Fall Street, extending from Fall Street northward to and bounded on the Northerly land of D.SCHOONOVEN and is the same premises where I now reside, together with all hereditaments and appurtenances thereunto belonging or in any appertaining; To have and to hold the premises above disserted to my said wife, Jennet Sherman, for the sole use and benefit during her natural life. And after her decease to revert to my children of my former wife, and to James SHERMAN, a son of my said wife, Jennet to be equally divided between them their heirs administrators and assigns.

Second I give and bequeath to my said wife, Jennet SHERMAN all my personal estate, household furniture, goods and chattels of whatever name or nature and also attributes of all debts due me, if there be any, to have and to hold the same to my wife JENNET during her natural life. And after decease to revert (as above confessed relative to the said estate) to my children by a former wife and James SHERMAN a son of my said wife, Jennet. And I do desire, direct and order that whithin one year after the decease of my said wife, Jennet SHERMAN, or as soon thereafter, as may be, the said Real Estate and the said Personal Estate shall be sold for the best price that can be obtained therefore either at private of public sale, and the avails thereof, after paying the necessary funeral expenses of my said wife JANET, equally divided between all of my said children by a former wife and said James SHERMAN share and share alike, their heirs and assigns forever.

Lastly, I hereby appoint my said wife Jennet SHERMAN sole executor of this my said last will and testament hereby revoking and annulling all former wills by me made in testimony whereof I have hereunto set my hand and seal at Seneca Falls this 23rd day of December, 1859. Benajah SHERMAN {L.S.}

The above instrument consisting of our sheet was at the date thereof signed, sealed, published and declared by the said Benajah SHERMAN as, and for his last Will and Testament in presence of us, who at his request and in his presence, and in the presence of each other have such scribed our names as witnesses thereto. Hiram A. PALMER residing at Seneca Falls, Seneca County N.Y. Joseph BABCOCK residing at Seneca Falls, Seneca County, N.Y.

July 25, 1865 Jennette HAYS-formally Jennette SHERMAN appears and claims that will be admitted to probate on the proof before the Surrogate and that Letters testamentary issue SURROGATE'S COURT to her. Henry (HENION) appears for Creditors and the heirs and next of kin and consents. In the matter of Proving the last Will and Testament thereto. Florinda VAN LUYL, Lucinda Van Of: VALKENBURGH, Mary CRAWFORD, William SHERMAN also appear and present thereto Benajah SHERMAN. Proof of service of citation for this day read and Deceased filed, served on the widow and all the heirs. Ordered that the subscribing witnesses be Re-examined. Seneca County, S.S. Hiram A. PALMER and Joseph BABCOCK being first duly sworn in open Court upon their several corporal oaths, each for himself doth depose and say that they are subscribing witnesses to the last Will and Testament of Benajah SHERMAN late of the town of Seneca Falls in the county of Seneca and the State of New York deceased. And these deponents do further say that the said Benajah SHERMAN deceased, did in the presence of each of these deponents, subscribe his name at the end of the instrument in writing which is now here shown to these deponents, and which purports to be the last Will and Testament of Benajah SHERMAN the said deceased, and which bears date on the Twenty-third day of December one thousand eight hundred and fifty nine. That the said deceased did at the time of subscribing his name to the said instrument aforesaid, declare the same to be his last Will and Testament; and these deponents did thereupon subscribe their own respective names at the end of said instrument, as attesting witnesses to the execution thereof; each at the request of the said deceased in his presence and in the presence of each other; That the said deceased at the time of so subscribing his name to said instrument as aforesaid and publishing said instrument as aforesaid, was upwards of twenty-one years of age, and a citizen of the United States; That he appeared to be and deponents believe he was of sound mind, memory and understanding, and not under restraint, and as deponents verily believe, in all respects competent to devise real estate, that each of these deponents was the other sign his name to said instrument in the presence of the said deceased.

Deponent PALMER says he wrote the will as requested by Mr. SHERMAN, that after it was written he carefully read it to Mr. SHERMAN, who seemed to understand it and said it was right, and that the will is now in the same condition as when executed, has not been altered. Be it remembered that heretofore, to with on the fourth day of April 1848, Abraham BLOOMER and Joseph DUNLAP the executors named in the Last Will and testament of Kezia SCOTT, late of Ovid in the County of Seneca deceased, appeared in open court before the Surrogate of the County of Seneca and made application to have the said Last Will and testament, which relates to personal estate proved; and on such application the Surrogate did ascertain by satisfactory evidence as far as the said executors could ascertain, who were the heirs and next of kin of the said testator and their residences. And said Surrogate did thereupon issue a citation in (___) form of law, directed to the said heirs and next of kin, by their respective names as fast as could be ascertained, stating their respective residences as far as the same could be ascertained requiring them to appear at the office of Said Surrogate in the Village of Waterloo in the county of Seneca on the 29th day of May then (next?), at ten O'clock in the forenoon of that day and alter it the probate of said Will and afterwards to wit, on the day & year & at the place last aforesaid, (satisfy?) (___) evidence by affidavits was produced and presented to said Surrogate of the Service and publication of Said citation in the moke prescribed by law and on that day, no one appearing to oppose the proof of said Will, such proceedings were thereupon had, that the said Surrogate took the proof of said Will herein after set forth on the day last aforesaid, and be adjudged the said will to be a valid will of personal Estate, and the proofs thereof to be sufficient; and that said last Will and Testament and the proofs and examinations taken in respect to the same be recorded which said Last will and testament and proofs are as follows that is to say;

In the name of God Amen, I, Keziah SCOTT of the town of Ovid in the County of Seneca, being mindful of my mortality, do this twentyforth day of September in the year of our Lord 1840 make and publish this my Last Will and testament in manner following:

First, I desire to be decently buried in the burying grounds by the side of my husband in the town of Ovid.

Also, I give and bequeath unto Abraham BLOOMER and Joseph DUNLAP, Deacons of the Baptist Church in the town of Ovid the sum of five hundred dollars to be held by them, and to be by them (_?_) the interest to be paid annually to the Baptist minister that shall preach to said church for his support, or if they shall think propper (sic) to purchase a house and Lot for a parsonage for the use of said minister and if there should be no such minister or church, then I desire the yearly interest to be paid to the treasury of the American and foreign Bible Society.

Also, I give and bequeath to my executors the sum of fifty dollars in trust to pay (over?) the sum in six months, after my decease to the person who, when the same shall be payable shall act (as?) measures of the American and foreign Bible Society formed in Philadelphia in the year Eighteen and thirty seven to be applied to the charitable uses and purposes of the said society and under its direction.

Also, I give and bequeath to my Executors the sum of eighty dollars, five dollars in trust to pay (over?) the sum in six months after my decease to the Baptist Education Society of the State of New York.

Also, I give and bequeath to my executors the sum of eighty-five dollars in trust to pay (over?) the sum in six months after my decease to the treasurer of the Baptist Missionary Union to be applyed (sic) to uses of said Society.

Also, I give and bequeath to my Executor Executors the sum of fifty dollars in trust to pay (over) the sum in six months after my decease unto the person who may act as treasurer of Baptist trust and publication Society in Philadelphia.

Also, I give and bequeath unto Leonard FERRIS, son of my sister, Phebe FERRIS, the sum of twenty five dollars to be paid as above.

Also I give and bequeath unto Margaret SMITH daughter of Elihu GROVES and Nancy GROVES the sum of ten dollars to be paid as above.

Also I give and bequeath Isaac CLARK son of Daniel CLARK the sum of one hundred dollars to be paid as above.

Also, I give and bequeath unto Sarah SCOTT wife of Daniel SCOTT, and Betsey HODGE wife of Edward, all the rest and residue of my personal Estate whatsoever and wheresoever of what nature, kind and quality (___) the same may be, and not herein before given and disposed of, after payment of my debts, legacies, and funeral expenses.

And I do hereby constitute and appoint Abraham BLOOMER and Joseph DUNLAP my executors of this, my last Will and testament.

In witness whereof I have hereunto set my hand and seal, the day and year first above written.

The above instrument consisting of one sheet was now here subscribed by Keziah SCOTT the testator in the presence of each of us and was at the same time declared by her to be her last will and testament, and we at her request sign our names hereto as attesting witnesses

Seneca County for Daniel SCOTT being duly sworn & (exercised?) by (law?) for the Surrogate of Seneca County testifies as follows:



I reside in Ovid, Seneca County. I was well acquainted with Kezia SCOTT now deceased, late of Ovid aforesaid. I was present as a witness and saw the said Kezia subscribe her name at the end of the instrument in writing now (Produced?) shown to me, bearing date the twenty fourth (24) day of September A.D. 1840 purporting to be the Last Will and T4estament of the said Kezia. The said Kezia SCOTT at the time of making the said subscription declared said instrument to be her Last Will & Testament and requested me to sign my name as witness thereto which I accordingly did as my name now appears, at the end of the memorandum which immediately follows said instrument at the time of the execution of said instrument by said Kezia as aforesaid. She was of the age of Seventy-eight years or thereabouts, of sound mind, memory - in all respects competent to dispose of real & personal property by will, and was under no restraint to my knowledge. She was then, and at the time of her death, which occurred on or about the 19th day of January 1848 an unmarried female. I saw David D. SCOTT the other attesting witness to said instrument sign his name as it now appears, at the end of said memorandum as such witness, in the presence of said Kezia at her request. The said Kezia SCITT resided with me at, and for several years previous to her death; no many days after her death I found the said instrument in a trunk in which the said Kezia kept her papers. I handed the same to Joseph DUNLAP, one of the executors named therein. No alteration was made in said instrument while the same remained in my possession. Sworn before me the 29th day of May 1848 Daniel SCOTT J.K. RICHARDSON, Surrogate Seneca County David D. SCOTT being duly sworn and examined by & before the Surrogate of Seneca County, testified as follows: I reside in Ovid, Seneca County, I was well acquainted with Kezia SCOTT, now deceased, late of Ovid aforesaid. I was present as a witness and saw the said Kezia SCOTT subscribe her name at the end of the instrument in writing now provided and shown to me, bearing date the twenty-fourth (24th) day of September, (1846) one thousand Eight hundred and forty six, purporting to the Last Will & Testament of the said Kezia SCOTT deceased. I saw Daniel SCOTT the other attesting witness to said instrument, sign his name as a witness thereto as it now appears at the end of said memorandum, this was done by him in the presence of the said Kezia SCOTT, and at her request. SCOTT Seneca County by Joseph DUNLAP of Ovid in said county being duly sworn & examined by before the surrogate of Seneca County, testified as follows: I drew the instrument in writing now produced & shown to me, bearing date the 24th day of September, 1846 & purporting to be the Last Will & testament of Kezia SCOTT. I did so at her request. I read the same to her & she approved of it. I was present when the same was executed by her; remained in her possession. After her death, I received said instrument from the hands of Daniel SCOTT, with whom said Kezia resided at the time of her death. Said instrument is now in the same condition unaltered, as the same way in, which so executed. Sworn before me the 29th day of May 1848, J.K.
