According to the Charley Reese, “Hate crime” laws leads to totalitarianism. In this country hate crime judge the motive. According to the writer hate crime laws should not judge the motive because crime is a crime. The motive doesn’t take any matter in the crime and I agree with the Charley Reese that hate crime leads to totalitarianism.
I am agreeing with Charley Reese because crime laws is a step towards totalitarianism is right. We judge the motive in here, but we should not do that, crime is a crime, it doesn’t matter what motive it is because crime harms others. I think there should be same punishment. Charley Reese says that (page-137) “to make a distinction between crimes based on motive is nonsense and injustice.” For example, the two persons make the same crime, but the motives are different. The motive of one person is to treat his child and the motive of the other person is to put the money in the pocket to enjoy the life. Here the motives of the two persons are different but the crime is same. So, both should be punished in the same way.
I agree with that equal actions should receive equal punishment because if the action is same, obviously the punishment should be same and it doesn’t matter who did the action. Charley Reese says that (page-137) “To punish a crime of prejudice more than an otherwise identical crime of greed malice is a slap in the face to the victims to the ordinary criminals”. According to the sentence, to punish a crime of prejudice is more offensive for the people who are affected. By this sentences he wants to tell us that crime laws is a laws towards the totalitarianism. I think hate crimes are the small portion of crimes. Charley Reese says that (page-137) “hate crime legislation is just laying the groundwork for hate speech legislation.” I think hate crime laws will lead to hate speech laws because the hate crime is a violent physical or verbal attack on the free speech so we can say that hate crime laws will lead to hate speech law will lead to loss of freedom of speech because, there is some restriction on the speech according to the law. So, it leads to loss of freedom of speech. For example nobody can enter in anybody’s house and shout whatever he wants and the loss of freedom of speech leads to totalitarianism. So, we can say that hate crime law leads to loss of freedom of speech and loss of freedom of speech leads to totalitarianism.
So, I think the hate crime laws leads to the totalitarianism. So, I agree with the author.
