A cultural heritage database and register have been established under Part 5 of the Aboriginal Cultural Heritage Act 2003 and the Torres Strait Islander Cultural Heritage Act 2003.
Persons carrying out activities that may impact on Aboriginal or Torres Strait Islander cultural heritage can request information from the database and register by submitting undertaking a an Aboriginal and Torres Strait Islander cultural heritage search requestthrough the department’s online portal of the Aboriginal and Torres Strait Islander cultural heritage database and register [https://forms.business.gov.au/smartforms/derm/search-request-submission-form/]. Persons undertaking submitting an Aboriginal and Torres Strait Islander cultural heritage search request must indicate which category of the duty of care guidelines [duty-of-care-guidelines] applies to the proposed activity.
A short description of any cultural heritage recorded on the database and register will be provided together with the contact details of the relevant Aboriginal or Torres Strait Islander party for the search area.
It is important to note that a person does not necessarily satisfy the cultural heritage duty of care simply by undertaking a search of the database and register.
